Watson refuses to pay. Wherefore your petitioner ? ? may ? required of the said Rufus H. Watson to be and appear at the said Superior Court for said county to answer your petitioner complaint ? ? Georgia, Monroe County: TO THE SHERIFF OF SAID COUNTY: Whereas, Abraham Lake instituted his action of complaint against Rufus H. Watson returned to the August Term 1866 of the Supr Court of Monroe County for the sum of Two hundred and twenty four 70/100 dollars, note alledged to be due him by the said Rufus H. Watson and afterwards, and before judgment on said cause, the said Abraham Lake died intestate: And since his death, John W. Lake of said county, was appointed Administrat upon his estate letters of Administration being granted to him dated 185 , which are now ready to be shown to the Court: And whereas, it has been to said Court shown, by the said John W. Lake and appears of record in the proceedings of said Court, that the said action is still pending, and in no way disposed of: Now, we hereby command you, that you make known to the said Rufus H. Watson that he be, and appear at the next Superior Court, to be held in and for said county of Monroe on the fourth Monday in February next, then and there to show cause why the said John W. Lake should not be made a party Plaintiff in said cause, as Administrat of the estate of Abraham Lake deceased, and the said cause proceed to final judgment, in the name of said John W.
